1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your use of baystaterustprevention.com and your communications and transactions with Bay State Rust Prevention (“Bay State Rust Prevention,” “we,” “us,” or “our”).

By accessing our website, submitting a form, requesting an estimate, scheduling a service, making a payment, or otherwise interacting with us, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the website or submit information through it.

2. About Bay State Rust Prevention

Bay State Rust Prevention is a Massachusetts local service business located at:

Bay State Rust Prevention
156 Hartwell St, Suite A
West Boylston, MA 01583
United States

You may contact us at info@baystaterustprevention.com or (508) 859-9714.

3. Website Information

The content on this website is provided for general informational and promotional purposes. We make reasonable efforts to keep website information accurate, but we do not guarantee that every description, price, image, estimate, service detail, availability statement, or other item will always be complete, current, or error-free.

Website content does not create a binding service agreement, warranty, quote, or guarantee unless expressly included in a written estimate, invoice, work order, warranty document, or other agreement issued by Bay State Rust Prevention.

We may update, remove, correct, or change website content at any time without notice.

4. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to purchase services or submit a service request.

By scheduling services for a vehicle, you represent that you are the vehicle’s owner or have the owner’s authority to approve the requested work.

5. Estimates and Quotes

Website prices, advertisements, starting prices, promotions, and telephone discussions are not final quotes unless expressly identified as such in writing.

Estimates may depend on factors including:

  • Vehicle type, size, age, and condition
  • Existing rust, corrosion, coatings, dirt, grease, or damage
  • Required preparation, cleaning, disassembly, or rust removal
  • Requested products, coverage, and service level
  • Labor, materials, accessibility, and scheduling requirements
  • Conditions discovered after inspection or work begins

A final price may change if the vehicle’s actual condition or requested work differs from the information originally provided. When practical, we will notify you before performing material additional work that increases the price.

Estimates are valid only for the period stated in the estimate. If no period is stated, an estimate may be revised based on changes in labor, materials, vehicle condition, service scope, or availability.

6. Appointments and Vehicle Access

Appointments are subject to availability and are not guaranteed until confirmed by Bay State Rust Prevention.

You are responsible for:

  • Providing accurate vehicle and contact information
  • Arriving at the agreed time or arranging timely vehicle delivery
  • Providing keys and access needed to perform the approved work
  • Removing valuables and personal property from the vehicle
  • Disclosing known mechanical, electrical, structural, or safety issues
  • Disclosing prior repairs, coatings, modifications, or damage that may affect the service
  • Obtaining any authorization required from the vehicle owner, lessor, lender, or insurer

Service times are estimates. Completion may be delayed by vehicle condition, hidden corrosion, product-curing requirements, parts or material availability, weather, equipment issues, staffing, or other conditions outside our reasonable control.

7. Cancellations, Rescheduling, and Deposits

Any cancellation, rescheduling, deposit, or no-show terms disclosed in your estimate, invoice, appointment confirmation, or work order are incorporated into these Terms.

Because appointment time and materials may be reserved for your vehicle, deposits may be nonrefundable to the extent disclosed before payment and permitted by law.

Contact us as soon as possible if you need to cancel or reschedule. We reserve the right to reschedule an appointment due to unsafe conditions, equipment failure, staffing issues, product availability, severe weather, or other circumstances beyond our reasonable control.

8. Service Authorization

By approving an estimate, signing a work order, providing payment, delivering a vehicle, or otherwise authorizing work, you authorize Bay State Rust Prevention to perform the listed services and reasonably related steps necessary to complete them.

These steps may include inspection, cleaning, preparation, masking, lifting the vehicle, removing or loosening accessible shields or components, applying products, documenting vehicle condition, and performing other work described in the applicable service documents.

We will not knowingly perform materially different additional work without your authorization, except where immediate action is reasonably necessary to prevent damage, address a safety issue, or comply with law.

9. Existing Vehicle Conditions

Rust-prevention and undercoating services do not restore a vehicle to new condition and cannot reverse all existing corrosion, metal loss, structural deterioration, mechanical damage, or prior improper repairs.

You acknowledge that older vehicles and vehicles exposed to salt, moisture, off-road conditions, prior coatings, or existing corrosion may have hidden or weakened components. Cleaning, preparation, lifting, air pressure, product application, or ordinary service procedures may reveal pre-existing deterioration that was not previously visible.

Unless caused by our failure to exercise reasonable care, Bay State Rust Prevention is not responsible for pre-existing damage, hidden defects, weakened fasteners, brittle plastics, damaged wiring, deteriorated seals, failing coatings, corrosion concealed by dirt or prior products, or problems caused by modifications or prior repairs.

10. Results and Maintenance

Results vary based on the vehicle’s age, design, materials, condition, use, storage, exposure to road salt and chemicals, climate, mileage, preparation, maintenance, and existing corrosion.

No rust-prevention treatment can guarantee that rust or corrosion will never develop. Products may wear, migrate, collect dirt, require inspection, or need periodic touch-ups or reapplication.

You are responsible for following care, inspection, maintenance, and reapplication instructions provided with your service. Failure to follow those instructions may reduce performance and may affect any applicable warranty.

11. Warranties

Any service or product warranty is governed solely by the written warranty terms provided for that service or product. Warranty coverage may vary by product, vehicle, service package, inspection schedule, maintenance history, and other stated requirements.

Manufacturer warranties, when applicable, are provided by the manufacturer and are subject to the manufacturer’s terms, exclusions, procedures, and remedies.

Except for warranties expressly provided in writing and rights that cannot legally be excluded, services and website content are provided without additional express or implied warranties.

Nothing in these Terms limits any warranty or consumer right that cannot be waived under applicable law.

12. Payments

You agree to pay all charges approved through an estimate, invoice, work order, appointment confirmation, or other service agreement, including authorized additional work and applicable taxes.

Payments may be processed through Stripe, QuickBooks, Intuit, or another third-party payment provider. Your use of a payment platform may also be subject to that provider’s terms and privacy policy.

Unless otherwise agreed in writing, payment is due according to the terms shown on the applicable invoice or service document.

You agree to provide current and accurate billing information and represent that you are authorized to use the selected payment method.

13. Promotions and Special Offers

Promotions, discounts, coupons, and special offers may be subject to separate eligibility requirements, expiration dates, service limitations, appointment availability, vehicle restrictions, and other conditions.

Unless expressly stated otherwise:

  • Offers have no cash value
  • Offers cannot be combined
  • Offers apply only to qualifying services
  • Offers are subject to availability
  • Offers may be modified or withdrawn before acceptance

Where permitted by law, we may also send occasional specials, offers, maintenance reminders, and company updates. You may unsubscribe from promotional emails using the unsubscribe link in the message.

Unsubscribing from marketing emails does not prevent us from sending communications required to complete or document a transaction or service request.

  • Violate any applicable law or regulation
  • Submit false, fraudulent, misleading, or unauthorized information
  • Impersonate another person or misrepresent your identity

  • Scrape, copy, or harvest information through unauthorized automated means
  • Use website content in a way that infringes intellectual-property rights
  • Use the website to harass, threaten, defame, or harm another person

We may restrict or terminate access when we reasonably believe a user has violated these Terms or threatens the security or operation of the website.

17. Intellectual Property

The website and its original text, design, graphics, logos, photographs, videos, service descriptions, layout, and other content are owned by or licensed to Bay State Rust Prevention and are protected by applicable intellectual-property laws.

You may view and print website content for personal, noncommercial use. You may not reproduce, republish, distribute, modify, sell, license, scrape, or commercially exploit website content without prior written permission.

Third-party names, logos, products, and trademarks remain the property of their respective owners. Their appearance on the website does not transfer ownership or imply an endorsement beyond any actual business relationship.

18. Photos, Reviews, and User-Submitted Content

If you voluntarily submit a review, testimonial, photograph, video, or other content for promotional use, you represent that you have the right to provide it and that it does not violate another person’s rights.

We will not publicly use personally identifying customer content for advertising without permission when permission is reasonably required. Any specific photo or testimonial release will be governed by its own terms.

We may document vehicle condition before, during, and after service for quality control, customer communication, warranty records, dispute resolution, and internal business records.

19. Third-Party Links and Platforms

The website may link to third-party websites, payment processors, maps, social-media platforms, scheduling tools, review sites, or other services.

We do not control and are not responsible for the availability, security, accuracy, content, terms, or privacy practices of third-party services. Your use of those services is governed by the third party’s own terms and policies.

20. Disclaimer of Website Warranties

To the fullest extent permitted by law, the website is provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, secure, error-free, free from harmful components, or compatible with every device or browser.

We do not guarantee that website content, online estimates, advertising results, third-party links, or communications will always be complete, accurate, current, or available.

This disclaimer does not limit rights or remedies that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by law, Bay State Rust Prevention and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, inability to use the website, reliance on website content, or third-party services.

Liability relating to actual vehicle services will be determined by the applicable estimate, invoice, work order, written warranty, facts of the claim, and governing law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, willful misconduct, or other rights that cannot legally be waived.

22. Indemnification

To the extent permitted by law, you agree to be responsible for claims, damages, or expenses arising from your unlawful misuse of the website, your material violation of these Terms, or content you submit without the required rights or authorization.

This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, or responsibility that cannot legally be transferred.

23. Events Outside Our Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, fire, flood, power or internet outages, labor disruptions, supply shortages, government actions, transportation interruptions, equipment failure, public emergencies, or failures of third-party platforms.

24. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal action arising from these Terms or the website shall be brought in a court of competent jurisdiction located in Massachusetts.

Before filing a claim, the parties are encouraged to make a good-faith effort to resolve the issue directly.

25. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

26. No Waiver

A delay or failure to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.

27. Entire Agreement

These Terms, our Privacy Policy, and any applicable estimate, invoice, work order, warranty, appointment confirmation, or written service agreement form the agreement governing the applicable interaction or service.

If a signed or specifically accepted service document conflicts with these general website Terms, the more specific service document controls for that service.

28. Changes to These Terms

We may revise these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively from the date posted unless otherwise stated or required by law. Continued use of the website after revised Terms are posted constitutes acknowledgment of the updated Terms.
